The agreement
Before the binding agreement is signed, the customer will be given the opportunity to read and agree to these general terms and conditions. Certain situations that are not included in these general terms and conditions will be assessed on the basis of these general terms and conditions.
The agreement is concluded when the customer agrees and adheres to the associated conditions.
After the customer has agreed to the agreement, we immediately confirm this with the order confirmation in an email. As long as we have not sent the confirmation, the customer can exercise his right of cancellation.
After the customer agrees to the agreement, we take the necessary measures to protect the customer's personal data. We ensure a safe website environment.
Agreements between us and the customer to which these general terms and conditions apply are exclusively governed by Dutch law. Even if the consumer lives abroad.
The Vienna Sales Convention does not apply.
Information regarding description of artworks and legal pages
The works of art contain a detailed and honest description. The photos of the artworks correspond to the artworks in real life as much as possible. The colors of the artworks in the photos may differ slightly from the colors of the artworks in real life. This is due to different lighting.
All photos, specifications and dates of the artworks that we offer are an indication and cannot be used for compensation or termination of the agreement.
Each artwork and legal pages on this website contain extensive information. This means that the customer knows exactly what his rights and obligations are. This way there can be no confusion about the price including tax, shipping costs for sending and returning one or more works of art, agreeing to the agreement and how this happens, what the agreement entails, our returns policy, payment options, delivery options, from and until when offers apply and information about storing personal data.
We communicate clearly about our returns policy, privacy statement and contact options via pages on our website.
The prices and payment
We can check whether the customer meets the payment obligations and whether the customer has the opportunity to fulfill this obligation. If this is not the case, we do not have to agree to the agreement.
The prices of the artworks on our website include VAT.
If payment is not made (in full), we will collect the amount due using a collection agency and charge costs that must be paid by the customer.
The shipping and delivery
After an order has been confirmed, we will ship it as soon as possible. Original paintings from a collection and Limited edition fine art prints are shipped within 7 business days. Original paintings made to order (personalized) must be created first. The duration of this and the time of shipment will be determined in consultation with the customer. Open edition fine art prints are created after purchase and ship within 4 weeks.
Delivery will be outsourced to a third party. Track & trace is always used where possible. The artwork is always delivered to the address provided by the customer. The delivery of the order depends on the postal company. The customer will be informed of this after we have shipped the order.
Complaints
If there is anything incorrect with the purchased artwork, the customer must notify them immediately by contacting hi@valeriegyzel.com.
For complaints, customers can contact hi@valeriegyzel.com. If the complaints concern matters discussed in the agreement, the customer must let us know in a detailed and clear email within two months of agreeing to the agreement. We will then contact you within two weeks. If the complaint requires an extensive response, we will let you know within two weeks that we have received the complaint and that we are working on it, but more time to find a solution.
Complaints can also be handled via the European ODR platform (http://ec.europa.eu/odr).
